Identity and address of the data controller

This Privacy Notice applies to MAYAN KAKAW TULUM SAPI DE CV, hereinafter “the Proptech”. The processing of your personal data is of the utmost importance; we reiterate our commitment to your privacy and to the right to informational self-determination. The purpose of this notice is to inform you of the treatment that will be given to your personal data when it is collected, used, stored, transmitted and/or transferred by the Proptech, in compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (the “Law”), its Regulations and Guidelines.

The data controller is the Proptech, which collects the data to attend to a possible provision of services, the provision of a contracted service, or the development of the respective contractual relationship. For the purposes of this notice, the Proptech states as its address: Andador Kaan 56, Local 2, Aldea Zama, Tulum, Quintana Roo, C.P. 77760, México.

Personal data

The categories of personal data to be collected and subject to processing are:

  • Identification and contact data.
  • Tax data (RFC, certificates, receipts).
  • Financial and asset data.
  • The documents you upload to the platform for the provision of the service.

If you do not have this information, we will not be able to continue with the process of contracting the service or with the fulfillment of the corresponding contractual obligations.

Financial data we process

To fulfill the purposes set out in this notice, financial data such as bank account numbers, account statements, balances and income may be collected and processed. The data collected will be processed under strict security measures that guarantee its confidentiality. Where there is not yet a legal relationship, express consent for the processing of financial or asset data is given by accepting this notice when using the platform, an acceptance that is stored as evidence.

Purposes of the processing

  1. Providing you with the services of property management and vacation rental platform: administration of properties, collections and payments of owners and tenants, accounting and reports.
  2. Complying with applicable law and with requirements of competent authorities.
  3. Complying with the contract entered into between the data subject and the Proptech.
  4. Complying with the contracted accounting and tax services (including the issuance of CFDI invoices and tax returns).
  5. Communicating with you about your account, requests and the status of your procedures.
  6. Statistical purposes and improvement of our services.

If you do not agree with any purpose, you may state your refusal through the mechanism in the section “Exercise of ARCO rights”. You may also request to be registered in REPEP (repep.profeco.gob.mx) so that your information is not used for marketing or advertising purposes.

Data security

the Proptech implements the technical, administrative and physical security measures necessary to protect the integrity of your data and to prevent its damage, loss, alteration, destruction or unauthorized use. Security breaches that significantly affect your rights will be reported to you immediately in accordance with article 20 of the Law. Our personnel and service providers keep your data confidential, an obligation that remains even after the relationship ends.

Transfers

the Proptech may share your data with national or foreign third parties solely to fulfill the purposes described (for example tax authorities, invoicing providers or financial institutions involved in the operation), in accordance with article 37 of the Law. Outside those cases, we do not assign, sell or transfer your data to unrelated third parties.

Exercise of ARCO rights

You may exercise your rights of Access, Rectification, Cancellation and Opposition, revoke your consent or limit the use or disclosure of your data by writing to info@mayankakaw.com, proving your identity. Delivery of the data is free of charge; only justified shipping or reproduction costs, if any, are covered. For any question you may also consult the Ministry of Anticorruption and Good Government (www.gob.mx/buengobierno), which took over the functions of INAI regarding personal data held by private parties.

Changes to this notice

the Proptech reserves the right to make modifications or updates to this notice at any time, which will be published on this same page.
